Our Terms and Conditions

When buying goods and services on the Internet, you, the consumer are entering a legally binding contract. The following Terms and Conditions are set in accordance with UK Trading Standards, the UK law being the applicable law. Please take the time to read the following information, ideally. These Terms and Conditions apply to online transactions only. Different policies apply to in-store purchases.

We are required to inform you that all sales transactions on this web-site are governed by English law and you must agree to submit any dispute to the non-exclusive jurisdiction of the English courts. All orders are subject to these terms and conditions and no amendments will be accepted by us. These terms and conditions do not affect your legal rights.

Pricing & Payment

All prices are in £ sterling inclusive of VAT and include free UK Mainland delivery; please contact us for delivery pricing to Northern Ireland, Isle of Man, Channel Islands, Scottish Islands and Scottish post codes displayed below. In some circumstances we will ship goods abroad – contact us for more details. Please refer to our 'Delivery & Despatch' section for more detailed information.

We accept all major credit and debit cards, but not American Express. All offers and products are subject to availability.

In the event of an item being out of stock with either ourselves or our suppliers, we will not finalise your payment with our payment processing service and may invoke our right as a retailer not to accept your offer to buy the goods. If this is the case, then we will inform you at our earliest opportunity. Alternatively, we may be able to offer a substitute item of equal or greater value which you may choose to accept or decline.

Returns

In accordance with the Distance Selling Regulations, you have the right to cancel your order at anytime either before or up to 7 (seven) days after delivery of your product. You must inform us about your cancellation in writing (not by telephone) either by:

  • Writing to us at ADC Drums, 19 Cheapside, Liverpool, L2 2DY.
  • Emailing us at info@adcdrums.co.uk

You can return the product to us in person by visiting the shop or by post. You must provide proof of purchase. Ideally, this should be your original receipt but it can be a credit card receipt, cheque stub, card statement or anything that indicates when the item was purchased from ADC Drums. Your product must be in a complete and unused state without any marks. The item should be returned with the original box, packing and accessories, in perfect re-saleable condition. Any extra ‘freebies’ received with the product (such as when we throw in a pair of sticks etc free of charge) must also be returned. You (the customer) must bear all costs incurred in returning the item to ADC Drums.

We will not cancel your purchase when:

  • You return your product without proof of purchase.
  • The goods were a special \ custom order to your exacting requirements.

Guarantees & Warranties

If a problem occurs with a product and you believe the product to be deemed as 'faulty', we will deal with the situation as quickly as possible and endeavour to provide a swift resolution. With the exception of ‘consumable’ items (drumsticks, drum skins, guitar strings), most goods have a 12 month manufacturers guarantee against faulty materials, defects or workmanship. As a consumer, your statutory rights mean that you have the right to pursue a problem with faulty goods with us (the retailer) and\or the manufacturer. If for reasons beyond our control we are unable to provide you with an exchange or replacement and you do not wish to receive a refund, we will offer to pursue the manufacturer on your behalf in order to rectify the problem with the product. In order to qualify for a refund or exchange, the product must be accompanied by proof of purchase.

Where goods are returned as ‘faulty’ but have been used for a significant amount of time and the customer refuses a replacement product in favour of a refund; we are within our rights to make a refund, less an amount reflecting the time period of usage the customer has received from the product. This amount will vary depending on the expected lifespan of an individual item. If the customer disagrees with the amount offered, then it is the onus of the customer to seek the advice of an independent assessor to calculate an alternative amount and present their findings to us.

Unless there is visible evidence of a manufacturing fault, guarantees do not cover consumable items (e.g. drumsticks, heads, strings etc) or faults caused by accident, neglect, misuse or normal wear and tear. Synthetic drumsticks offering extra durability are subject to conditions set out in their manufacturer’s warranty. You are advised to read and study any information enclosed by the manufacturer to make sure you are aware of any warranty limitations.

THIS RETURNS POLICY DOES NOT AFFECT YOUR STATUTORY RIGHTS

Dispatch & Delivery

Depending on weight and size, we will send out goods either by Royal Mail 1st or 2nd Class Recorded delivery, or by 48 hour courier service. If you require guaranteed next-day delivery, we can only offer this for items that we would normally send by post and you will need to pay an extra charge for this service.

For orders placed by 1pm Monday – Friday (excluding Bank Holidays), we will endeavour to dispatch the same day. For orders placed after 1pm Friday, or at any time on Saturday/Sunday, goods will be dispatched on the following working day (not including Bank Holidays). Delivery should take no more than two working days (unless you live in a remote area where courier deliveries are not made daily). Deliveries do not take place on Saturdays or Sundays. If goods are not received within the described timescale, please contact us.

Courier deliveries will require a recipient's signature. If the courier cannot get a reply from the address you have requested us to send to, they will leave a card in the letterbox indicating that they have tried to deliver. This card will also contain instructions to phone their local depot to arrange a suitable day for re-delivery, or may even offer the option of personal collection. If they do not hear from you, they will try a further 2 (two) attempts to make delivery. If they still fail to get an answer, your parcel will be returned to us and you will incur an additional charge for re-delivery. On occasion, it has been known for some customers to request that we instruct the courier to leave their parcel outside an address without obtaining a signature. This is strictly not possible! Deliveries are confined to the shipping address post code supplied by the customer. It is not possible to change the shipping address post code after an item has been dispatched without incurring further charges. Any such charges must be paid for by the customer.

All dispatched postal items may occasionally be subject to delay for reasons beyond our control, resulting in either late or failed delivery. Royal Mail will not consider an item lost until 15 WORKING DAYS have passed since the date of posting. Therefore, we are unable to launch any claims for failed deliveries until that time period has passed (longer during times of industrial action). Should an item turn out to be lost, we will of course replace it.

If the Royal Mail attempt to deliver a recorded item and do not receive a reply from your address, they will leave a card in your letterbox informing you that they have attempted delivery and have returned your parcel to your nearest depot. The onus will then be on you to collect the parcel which they will keep for a limited period of time. If you do not collect your parcel within the specified time period they will return the parcel to us. In this situation, you may choose to incur an additional charge for re-delivery or cancel your order altogether.

Scottish Courier Deliveries

For items that require delivery by courier to the following Scottish post codes, an additional surcharge will be incurred:

FK 17-99, G 83, IV 1-28, IV 33-39, KW, PA 21-33, PA 35-40, PH 18-26, PH 30, PH 31-41

Unfortunately, this is because courier companies are now finding it more expensive to deliver to these locations and have passed this cost onto their customers. If you require delivery to any of the above post codes or a Scottish Island location, please contact us first for a shipping quote before you commit to buy.

Data Protection & Security

All payments for online orders are securely processed by the PCI DSS compliant Sage Pay payment processing system. Customer credit card data for online transactions is not visible to any member of ADC Drums staff. Furthermore, we do not harvest records of customer information for use by third parties. We operate an optional opt-in system for our store mailing list which you may remove yourself from at any time. When you order by telephone with your credit card, all retailer copies of credit card receipts are shredded following the sale. Customer copies are sent out with the goods but only display the last four card digits and expiry date. ADC Drums endeavour to operate strictly within current PCI DSS regulations and have implemented the necessary measures required for our merchant level.

These terms and conditions do not affect your legal rights. We are required by law to tell you that sales can be concluded in English only and that no public filing requirements apply.
